Scope

TestSafe provides audit, assessment and reporting services only. We do not provide legal advice, draft settlement agreements, respond to tribunal claims, or act as legal representatives. Where a situation requires a solicitor, we will tell you clearly and refer you accordingly.

Why now

The Fair Work Agency launched in April 2026. It has over 550 inspectors and the power to issue civil penalties of up to £20,000 per worker for NMW breaches alone. Most small employers have not reviewed their records since it launched. A pre-assessment costs a fraction of a single penalty. It also demonstrates to any inspector that you took reasonable steps to get it right, which matters when they are deciding how to respond to what they find.

FAQs

Common questions about the Fair Work Agency pre-assessment

What is the Fair Work Agency?

A UK Government body launched in April 2026 with consolidated powers to inspect, fine and prosecute employers on minimum wage, employment agency conduct, holiday pay and modern slavery breaches.

What does the £325 starting fee cover?

A micro-business FWA pre-assessment covering NMW compliance, holiday pay calculation, right to work checks, payslips, working time records, contracts and core employment policies. A written gap analysis and prioritised action list is produced within five working days. Larger businesses are quoted based on headcount.

Will this stop us being inspected?

No, but it tells you exactly what an inspector would find before they arrive, so you can fix the gaps on your terms.

How long does it take?

Typically half a day on site for a small employer, with a written gap analysis within a working week.

Need more than just this?

If you've got two or more on your list, an annual or retained package usually works out cheaper.
